Public Works /Zoning

The City of Deer Park is a zoned community. The Zoning Ordinance specifies purposes for which the land in each of the zoning category may be used. Some uses are permitted as a matter of right, and others require Specific Use Permits. Rezoning Process
A rezoning is required in order to change the uses legally allowed upon a piece of property. Rezoning applications are made to the Public Works Department, which evaluates them and makes recommendations to the City at the time may be less than six, the following is required:

Rezoning Permit

A rezoning permit is required when a property owner proposes to use his land for purposes other than those permitted by the current zoning classification. The requests are reviewed by the Public Works Department and then forwarded to the Planning and Zoning Commission and City Council.

Variance Permits
Variance permits are requested by citizens in specific cases where strict enforcement of a zoning regulation would cause unnecessary or unusual hardship. The board of adjustments vary or modify a regulation.

Day Care in Residential Zoning
Day care is limited to six children or less (including your own children) within any part of a 24 hour day, even if the total at the time may be less than six, the following is required:

  • Site must contain a minimum of 256 square feet per child.
  • A minimum outdoor play space of 80 square feet is required per child, per group occupying the space at one time.
  • Outdoor play spaces must be fenced on all sides by a solid fence or wall at least 4 feet in height.
